HOUSE CONCURRENT

RESOLUTION

 

 

AUTHORIZING THE ISSUANCE OF A TERM, NON-EXCLUSIVE EASEMENT TO KAHALUU POND, INC., FOR THE USE, REPAIR, AND MAINTENANCE OF THE SEAWALL LOCATED AT KAHALUU, KOOLAUPOKO, OAHU, TMK:  (1) 4-7-011:  SEAWARD OF 001.

 

 


     WHEREAS, the Kahaluu Fish Pond is on the State and National Registers of Historic Sites; and

 

     WHEREAS, State and federal officials have supported the restoration and maintenance of Hawaiian fishponds; and

 

     WHEREAS, it is critical for Kahaluu Pond, Inc., to be able to repair, replace, and maintain the existing seawall of this historic property; and

 

     WHEREAS, Grant of Easement No. S-4914 was issued to Kahaluu Pond, Inc., commencing from March 1, 1984 and expiring on February 28, 2014, for the right, privilege, and authority to use, maintain, repair, replace, and remove existing seawall over, under, and across state-owned land; and

 

     WHEREAS, on October 11, 2013, under agenda item D-6, the Board of Land and Natural Resources approved a new fifty-five year easement; and

 

     WHEREAS, pending legislative authorization for the issuance of a new easement, and the documentation and execution of the new easement, it is requested that a right of entry be issued to Kahaluu Pond, Inc., from March 1, 2014 until the new easement is prepared and fully executed, with a legislative authorization; and

 

     WHEREAS, section 171-53, Hawaii Revised Statutes, requires that prior approval of the Governor and prior authorization by the Legislature by concurrent resolution; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2015, the Senate concurring, that the Board of Land and Natural Resources is authorized to issue a term, non-exclusive easement to Kahaluu Pond, Inc., for the use, repair, and maintenance of the seawall located at Kahaluu, Koolaupoko, Oahu, TMK:  (1) 4-7-011:  seaward of 0001, for a term of fifty-five years, as approved by the Board of Land and Natural Resources; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources, Governor, and Kahaluu Pond, Inc.
