A BILL FOR AN ACT

 

 

RELATING TO BUSINESS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 201, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part    .  HAWAII PACIFIC SMALL BUSINESS CONSORTIUM

     §206-    Hawaii pacific small business consortium; established; purpose; governing board; staff.  (a)  There is established the Hawaii pacific small business consortium within the department of business, economic development, and tourism for administrative purposes.  The purpose of the Hawaii pacific small business consortium shall be to help small businesses obtain government contracts and to develop business opportunities for small businesses by combining their resources to offer services and solutions to the federal, state, and county governments and the commercial sector.

     (b)  The governing body of the Hawaii pacific small business consortium shall be a board of directors having seven members who shall be appointed by the governor for staggered terms pursuant to section 26-34; provided that:

     (1)  Each member shall have knowledge, experience, or expertise in small business, international trade, government contracting, or commerce;

     (2)  No member, nor the spouse, sibling, or child of a member, shall have any financial interest in a Hawaii business entity, including any stock holdings;

     (3)  No member shall be employed by the University of Hawaii; and

     (4)  Starting January 1, 2018, the board of directors shall expand to ten members.  Three additional members shall be appointed by the governor, pursuant to section 26‑34, to represent the business interests of foreign countries in the Pacific Rim.

     (c)  The members of the board of directors shall serve without compensation but may be reimbursed for expenses, including travel expenses, incurred in the performance of their duties.

     (d)  The board of directors shall appoint an executive director, who shall serve at the pleasure of the board of directors and shall be exempt from chapter 76.  The board of directors shall set the salary and duties of the executive director.

     (e)  The Hawaii pacific small business consortium shall submit an annual report to the legislature, no later than twenty days prior to the convening of each regular session, on the activities of the Hawaii pacific small business consortium and other accomplishments in the previous fiscal year.

     §206-    Establishment of the Hawaii pacific small business consortium special fund; fees charged.  (a)  There is created a special fund to be known as the Hawaii pacific small business consortium special fund into which appropriations made by the legislature and fees and funds collected by the Hawaii pacific small business consortium shall be deposited.

     (b)  The Hawaii pacific small business consortium shall charge businesses it assists a fee of not more than one per cent of the net profits the business generates as a result of the Hawaii pacific small business consortium's assistance.  Collected fees shall be placed into the Hawaii pacific small business consortium special fund.

     (c)  Funds in the Hawaii pacific small business consortium special fund shall be expended for:

     (1)  Operation of the Hawaii pacific small business consortium, including compensation for the executive director;

     (2)  The support of innovative programs that promote small business development around the Pacific Rim; and

     (3)  Issuing grants for innovative research and other programs in small business development, entrepreneurship, international trade, or technology development.

     (d)  All unencumbered and unexpended moneys in excess of $15,000,000 remaining on balance in the Hawaii pacific small business consortium special fund at the close of June 30 of each year shall lapse to the credit of the state general fund."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $10,000,000 or so much thereof as may be necessary for fiscal year 2015-2016 and the sum of $3,000,000 or so much thereof as may be necessary for fiscal year 2016-2017 for the Hawaii pacific small business consortium.

     The sums appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2015.
