Status

RELATING TO BEACH PROTECTION.

Incorporates beach land conservation under the general powers of the board of land and natural resources.  Expands the department of land and natural resources' beach restoration plans to include beach conservation plans.  Requires beach restoration plans to include, where appropriate, county participation and the formation of private-public partnerships.  Allows the department of land and natural resources to include studies about the effect of sea level rise and other coastal engineering studies when developing beach conservation plans that involve more than the nourishment of beaches with sand.  Renames the "beach restoration special fund" as the "beach restoration and conservation special fund".  Permits proceeds from the lease of public lands for an existing shoreline structure, matching funds to carry out a beach restoration and conservation plans, from private individuals or organizations, and transient accommodations tax revenues to be deposited into the beach restoration and conservation special fund.  Allows moneys from the beach restoration and conservation special fund to be used for conservation projects and all things necessary, useful, and convenient in connection with the restoration and conservation of beach lands.  Allocates $3,000,000 of transient accommodations tax revenues to the special land and development fund to be expended by the board of land and natural resources and board of directors of the Hawaii tourism authority, under a mutual agreement.  Allocates an annual amount of $3,000,000 of transient accommodations tax revenues to the beach restoration and conservation special fund and requires the fund to maintain a balance of $7,000,000 once that balance is achieved.

RELATING TO THE TRANSIENT ACCOMMODATIONS TAX.

Clarifies the distribution and allowable uses of Transient Accommodations Tax funds allocated and deposited into the Special Land and Development Fund in accordance with the Hawaii Tourism Authority's Strategic Plan.

Provides alternative civil enforcement options that may be utilized by the Board of Land and Natural Resources in the processing of natural and cultural resource violation cases.

RELATING TO USE PERMITS FOR SMALL BOAT HARBORS.

Clarifies that a person at least eighteen years of age need not obtain a marine surveyor's inspection nor provide documentation that the person is the owner of a vessel in order to be placed on a waitlist for a use permit to moor a vessel in a state small boat harbor.

RELATING TO SPECIAL SHORELINE ENCROACHMENT EASEMENTS.

Provides the Board of Land and Natural Resources discretion to grant easements for less than fair market value for structures that were authorized by a governmental authority and legally constructed landward of the shoreline within the record boundary of the landward property at the time of construction, but are now located seaward of the valid certified shoreline on public land.

Appropriates moneys for the office of planning and LUC to update agricultural soil classifications and maps.

RELATING TO THE WAILUKU STATE OFFICE MASTER PLAN.

Requires the department of accounting and general services to develop a Wailuku state office master plan to address the shortage of space in the Wailuku state office building and old courthouse building.  Makes an appropriation.

RELATING TO TORT LIABILITY.

Grants immunity to state agencies and employees of the State from liability for injury or damage to persons or property arising out of hazardous recreational activities; and establishes limitations on damages when a state agency and employee of the State are liable due to failure to guard or warn of a known dangerous condition, permission to participate in the hazardous recreational activity was granted for a fee, State was negligent in construction or maintenance of structures or equipment used in the hazardous recreational activity, participation or observation of a hazardous recreational activity was promoted recklessly or with gross negligence, or there was an act of gross negligence.

RELATING TO STATEWIDE INFRASTRUCTURE CAPACITY BUILDING CONSTRUCTION FINANCING.

Establishes the infrastructure capacity construction loan revolving fund to provide loans to counties, state agencies, or private developers for infrastructure improvements.  Appropriates funds for the administration and implementation of the infrastructure capacity construction loan revolving fund.

RELATING TO RESIDENTIAL PROPERTY.

Exempts from the definition of "historic property" any private residence that has not been entered, or nominated by the owner of the residence for entry, onto the Hawaii Register of Historic Places.  Clarifies that nothing in Chapter 6E, HRS, shall be construed to require a review by the DLNR for any private residence exempted under the new "historic property" definition.

RELATING TO THE REVIEW OF HISTORIC PRESERVATION PROJECTS.

Amends the definition of "programmatic agreement" to ensure an agreement is consistent with state or federal laws.

RELATING TO CONSERVATION.

Requires DOCARE to facilitate the execution of a memorandum of understanding for the joint enforcement of conservation laws, rules, and ordinances.  Requires DOCARE to submit a report to the legislature.  Sunsets on 6/30/16.

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes.  This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
