A BILL FOR AN ACT

 

 

relating to consumer protection.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§453-     Prescription of narcotic drugs.  (a)  Notwithstanding any other law to the contrary, no person licensed pursuant to this chapter shall:

     (1)  Prescribe a greater than thirty-day supply of any narcotic drug; or

     (2)  Issue a prescription for a narcotic drug that includes an authorization for automatic refill.

     (b)  For purposes of this section, "narcotic drug" means any drug or substance included in schedules II or III of title 21 United States Code section 812."

     SECTION 2.  Chapter 463E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§463E-    Prescription of narcotic drugs.  (a)  Notwithstanding any other law to the contrary, no person licensed pursuant to this chapter shall:

     (1)  Prescribe a greater than thirty-day supply of any narcotic drug; or

     (2)  Issue a prescription for a narcotic drug that includes an authorization for automatic refill.

     (b)  For purposes of this section, "narcotic drug" means any drug or substance included in schedules II or III of title 21 United States Code section 812."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
