A BILL FOR AN ACT

 

 

relating to highway safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to part X to be appropriately designated and to read as follows:

     "§286-    Flagger training and certification.  (a)  No person shall provide temporary traffic control in a street, road, or highway unless the person completes training and is certified by a program that meets the training and certification standards of the National Safety Council highway flagger training program, the American Traffic Safety Services Association flagger program, or an equivalent program that meets the same objectives.  A program shall not be deemed to be an equivalent program unless it meets the United States Department of Transportation Federal Highway Administration standards for the control of traffic through highway work zones, as defined in the Manual on Uniform Traffic Control Devices for streets and highways.

     (b)  No person may continue to provide temporary traffic control in a street, road, or highway unless the person undergoes training and certification requirements at least once every four years.

     (c)  This section shall not apply to law enforcement personnel who are employed by governmental entities.

     (d)  This section shall apply to any street, road, or highway, regardless of the ownership of the street, road, or highway."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  This Act shall take effect upon its approval.
