A BILL FOR AN ACT

 

 

relating to counties.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the counties need greater enforcement authority of near shore laws, rules, and regulations.  The State has insufficient staff to regularly provide enforcement and the counties may desire enforcement of county rules and regulations.  County lifeguards are currently not authorized to enforce state rules.

     The purpose of this Act is to allow for greater enforcement of state and county near shore laws, rules, and regulations by county lifeguards.

     SECTION 2.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    County enforcement in near shore zone.  County lifeguards may enforce state laws, rules, and regulations and any county rules and regulations not in conflict with state law within the near shore zone.  For purposes of this section, "near shore zone" means the area five hundred feet seaward from the shoreline."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
