A BILL FOR AN ACT

 

 

relating to death certificates.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the sharing of information regarding a deceased resident of Hawaii is a challenge for government agencies that provide payments, programs, and services.  The legislature also finds that moneys are distributed to deceased individuals and the recovery of those moneys is a daunting task, subject to hours of labor.

     The purpose of this Act is to establish a working group to develop a reporting system under which government agencies that make automatic payments to a recipient are timely notified of the recipient's death.

     SECTION 2.  (a)  There is established the death certificates working group, which shall develop a reporting system under which government agencies that make automatic payments to a recipient are timely notified of the recipient's death.  Payments shall include payments from programs and services such as medicaid, the employees' retirement system, and other post-employment benefits.

     (b)  The working group shall be composed of the following members or their designees:

     (1)  The director of finance, who shall serve as the chairperson of the working group;

     (2)  The executive director of the employees' retirement system;

     (3)  The director of health;

     (4)  The director of human services;

     (5)  The director of taxation;

     (6)  The chief election officer;

     (7)  The chief justice of the supreme court; and

     (8)  The chief medical examiner or coroner for each of the four counties.

     The director of finance shall also invite the Honolulu and the Kapolei district managers for the Social Security Administration to be two additional members of the working group.

     (c)  The working group shall be administratively placed in the department of budget and finance.  The director of finance shall initiate the organization of and provide staff support for the working group.

     (d)  Members of the working group shall serve without compensation, but shall be reimbursed for necessary expenses incurred during the performance of their duties.

     (e)  The working group shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature and governor not later than twenty days prior to the convening of the regular session of 2016.

     (f)  The working group shall cease to exist upon the adjournment sine die of the regular session of 2016.

     SECTION 3.  This Act shall take effect upon its approval.
