A BILL FOR AN ACT

 

 

relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:

     "§291C-    Slow-moving motor vehicles.  Any person driving a motor vehicle on a two-lane highway:

     (1)  Where passing or overtaking another motor vehicle is unsafe or not permitted;

     (2)  At a rate of speed less than the current flow of traffic; and

     (3)  With a line of five or more motor vehicles following immediately behind the driver's motor vehicle;

shall move off of the highway at the nearest reasonable and safe location to allow the trailing motor vehicles to overtake the driver's motor vehicle."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
