A BILL FOR AN ACT

 

 

relating to underground storage tanks.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that underground storage tank and tank system regulations are intended to protect the environment by preventing the release of petroleum and hazardous substances into the environment.

     The legislature further finds that protection of the environment and underground sources of drinking water is in the best interest of public health and safety, and an obligation of the State as required under article XI, section 7 of the state constitution.  The State has a role as a steward of this resource and should work to ensure a safe, dependable, and affordable water supply for present and future generations.

     Accordingly, the purpose of this Act is to reaffirm and declare the importance of clean water.  More specifically, this Act requires the department of health to implement standards that require all metal underground storage tanks and tank systems to install, operate, and maintain release prevention systems pursuant to federal regulations.

     SECTION 2.  Chapter 342L, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§342L-     Release prevention.  The department shall adopt standards of performance by rule, pursuant to chapter 91, for requiring the installation, operation, maintenance, and inspection of release prevention systems in all metal underground storage tanks and tank systems in the State.  Release prevention systems include but are not limited to low level leak detection, corrosion prevention of metal surfaces, and any other methods designed to prevent releases from existing underground storage tank or tank systems in a manner consistent with the protection of human health and the environment."

     SECTION 3.  Section 342L-3, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The director [may] shall adopt, amend, and repeal state rules in accordance with title 40 Code of Federal Regulations parts 280 and 281, without exception, controlling and regulating all underground storage tanks and tank systems.  All rules shall be adopted pursuant to chapter 91."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2016.
