A BILL FOR AN ACT

 

 

relating to public transit.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  Act 247, Session Laws of Hawaii 2005, is amended by amending section 9 to read as follows:

     "SECTION 9.  This Act shall take effect upon its approval; provided that:

     (1)  If none of the counties of the State adopt an ordinance to levy a county surcharge on state tax by December 31, 2005, this Act shall be repealed and section 437D-8.4, Hawaii Revised Statutes, shall be reenacted in the form in which it read on the day prior to the effective date of this Act;

     (2)  If any county does not adopt an ordinance to levy a county surcharge on state tax by December 31, 2005, it shall be prohibited from adopting such an ordinance pursuant to this Act, unless otherwise authorized by the legislature through a separate legislative act;

     (3)  If an ordinance to levy a county surcharge on state tax is adopted by December 31, 2005:

         (A)  The ordinance shall be repealed on December 31, [2022;]           ;

         (B)  This Act shall be repealed on December 31, [2022;]           ; and

         (C)  Section 437D-8.4, Hawaii Revised Statutes, shall be reenacted in the form in which it read on the day prior to the effective date of this Act."

PART II

     SECTION 2.  The director of finance is authorized to issue general obligation bonds in the sum of $          or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2015-2016 for a grant-in-aid to the city and county of Honolulu to provide financing for its rail transit project.

     The sums appropriated shall be expended by the city and county of Honolulu for the purposes of this section.

     SECTION 3.  The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2018, shall lapse as of that date.

PART III

     SECTION 4.  (a)  The Hawaii tourism authority is authorized to issue revenue bonds in the sum of $          or so much thereof as may be necessary for fiscal year 2015-2016 for a grant-in-aid to the city and county of Honolulu to provide financing for its rail transit project.

     (b)  The revenue bonds shall be secured by and payable from the transient accommodations tax revenues allocated to the city and county of Honolulu pursuant to section 237D-6.5(b)(3), Hawaii Revised Statutes.

     SECTION 5.  There is appropriated out of the revenue bond proceeds authorized by section 4 of this Act the sum of $          or so much thereof as may be necessary for fiscal year 2015-2016 to carry out the purpose of section 4; provided that any unexpended or unencumbered balance of the appropriation shall not lapse at the end of fiscal year 2015-2016 and shall lapse instead on June 30, 2018.

     The sum appropriated shall be transferred by the Hawaii tourism authority to the city and county of Honolulu to expend for the purposes of this Act.

PART IV

     SECTION 6.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 to provide financing for the city and county of Honolulu's rail transit project.

     The sums appropriated shall be expended by the city and county of Honolulu for the purposes of this Act.

PART V

     SECTION 7.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 8.  This Act shall take effect upon its approval; provided that parts II, III, and IV shall take effect on July 1, 2015.

Description:

Amends the sunset date of the county surcharge on state tax.  Authorizes the following to provide financing for the city and county of Honolulu's rail transit project:  (1) Issuance of general obligation bonds for a grant-in-aid; (2) Issuance by the Hawaii tourism authority for a grant-in-aid, secured and payable by transient accommodations tax revenues allocated to the city and county of Honolulu; and (3) An appropriation from the general fund.
