RELATING TO PARTITION OF HEIRS PROPERTY.

Adopts Uniform Partition of Heirs Property Act.  Establishes procedures and remedies for use in actions for partition of real property involving heirs property, real property held in tenancy in common that meets certain requirements.  (SB2408 SD1 HD1)

Status

RELATING TO ORDERS FOR IMMEDIATE PROTECTION.

Amends section 346-231, Hawaii Revised Statutes, to address inconsistencies in statutory requirements regarding orders for immediate protection; and allows the Department of Human Services discretion when to seek an order for immediate protection of vulnerable adults.

Status

RELATING TO PARENTAL RIGHTS.

Provides that a parent's rights may be terminated if the court determines, by clear and convincing evidence, that the child was conceived during an act of rape or sexual assault.  Creates a presumption that termination of parental rights is in the best interest of the child if the child was conceived as a result of the rape or sexual assault.  Takes effect on 1/7/2059.  (SD2)

Status

RELATING TO LICENSING.

Authorizes the board of dental examiners, Hawaii medical board, and board of pharmacy to deny a license to an applicant who has been disciplined by another state or federal agency and the board of nursing to deny a license to an applicant who has been disciplined by another state agency.  Authorizes the board of dental examiners, Hawaii medical board, board of nursing, and board of pharmacy to impose the same disciplinary action against a licensee as was taken by another state or federal agency.  Establishes conditions for the disciplinary action.  Prohibits a licensee from practicing until a final order of discipline is issued if the licensee has been prohibited from practicing in another state.  Requires any final order of discipline taken to be public record.  (SB2675 HD1)

RELATING TO NURSING.

Allows the Board of Nursing to more fully participate in Nursys, a national database for nurse licensees by sharing license and disciplinary action information.

RELATING TO CERTIFIED NURSE AIDES.

Repeals section 346-47 and amends sections 457A-1.5, 457A-2, and 457A-3, Hawaii Revised Statutes, to delete references to the Department of Human Services as licensing or certifying health care settings; and deletes references to the Department of Human Services investigating and disciplining certified nurse aides employed in health care settings.

Exempts from jury duty parents for the active care and custody of natural born or adopted children while the children are six months old and younger.  (SB2315 HD1)

Status

RELATING TO SERVICE OF PROCESS.

Allows notice of a water pollution and solid waste pollution violation to be given via a posting on a searchable government website or a sign conspicuously posted on the property, if appropriate, when attempts to serve the notice in person and by mail have been unsuccessful.  (SB2163 HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.  Those wishing to provide oral testimony will be limited to two minutes.
