A BILL FOR AN ACT

 

 

RELATING TO MARINE EVENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

"§200-    Regattas, marine parades, and surfing contests; permits; fee.  (a)  No person shall hold a regatta, marine parade, or surfing contest without the department's authorization, except that the department's authorization is not required if prior authorization has been secured from the Coast Guard.

(b)  Authorization shall be in the form of a permit.  All permit applications shall be on a form prescribed by the department.  The department may assess and collect a fee for the processing of the permit.

(c)  Permit applications shall be submitted to the department no less than forty-five days before the start of a proposed event.  The department shall notify an applicant in writing that it has received a completed application or has received an incomplete application, in which case the department shall specify why the application is incomplete.  The department shall approve or deny a permit within thirty days of receipt of a completed application; provided that if the department deems that a submitted permit application is not complete, the thirty-day period to approve or deny the permit shall commence upon the department's receipt of any documents, information, or fee necessary to complete the permit application.  If the department does not approve or deny the permit within the thirty-day period, the application shall be deemed approved by the department as of the first day following the expiration of the thirty-day period.

(d)  The department shall adopt rules, pursuant to chapter 91, necessary to effectuate this section.

(e)  As used in this section, "regatta", "marine parade", or "surfing contest" means an organized water event of limited duration that is conducted according to a prearranged schedule and that, by its nature, circumstances, or location, will introduce extra or unusual hazards to the safety of persons or property on the waters of the State."

SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.

Description:

Requires the submission of permit applications for regattas, marine parades, or surfing contests to DLNR at least 45 days before a proposed event.  Requires DLNR to approve or deny permits within 30 days of receiving a completed application.  Allows DLNR to assess and collect a fee for permit processing.  (HB1304 HD1)
