A BILL FOR AN ACT

 

 

RELATING TO PRIVATE FLIGHT SCHOOLS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 302A-424, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§302A-424[]]  Regulation or authorization of other schools and classes.  The department, at its discretion, may regulate schools, classes, or courses excepted from the definition of "private trade, vocational, or technical school"[.]; provided that the department shall authorize a private flight school that:

     (1)  Is physically present in the State;

     (2)  Is certified by the Federal Aviation Administration;

     (3)  Offers an advanced certificate for flight instructors;

     (4)  Requests department authorization; and

     (5)  Meets any other requirements established by the department by rule,

for the purposes of qualifying the flight school to participate in loan programs established pursuant to Title IV of the Higher Education Act of 1965, as amended."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2051.

Description:

Requires the Department of Education to authorize private flight schools that: (1) are physically present in the State; (2) are certified by the Federal Aviation Administration; (3) offer flight instructor certificates; (4) request authorization; and (5) meet other requirements established by the rules of the Department.  (HB190 HD3)
