A BILL FOR AN ACT

 

 

RELATING TO LOCALLY GROWN FOOD.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Farm to school grant program; farm to school grant program special fund.  (a)  There is established within the department of education a farm to school grant program; provided that the department of education shall coordinate with the department of agriculture to ensure that the grant program assists farmers participating in the Hawaii farm to school program under section 141-11 by providing grants to:

     (1)  Facilitate compliance with requirements of the Food and Drug Administration Food Safety Modernization Act;

     (2)  Implement United States Department of Agriculture good agricultural practices standards and audits;

     (3)  Perform United States Department of Agriculture hazard analysis critical control point procedures;

     (4)  Invest in food safety improvements on farms;

     (5)  Provide training for compliance with regulatory measures; and

     (6)  Harmonize the price at which farmers are required to sell their products with the price at which the department of education can afford to buy the products.

     (b)  The farm to school grant program shall be headed by a farm to school grant program coordinator, who shall work in collaboration with appropriate stakeholders, including the farm to school coordinator identified in section 141-11(b) and the University of Hawaii college of tropical agriculture and human resources.

     (c)  There is established in the state treasury the farm to school grant program special fund to be administered by the department of education and into which shall be deposited appropriations made by the legislature to the special fund.  Moneys in the special fund shall be used for the purposes of this section.

     (d)  The farm to school grant program special fund shall be overseen by a farm to school grant program special fund manager, who shall work in collaboration with appropriate stakeholders, including the farm to school coordinator identified in section 141-11(b) and the University of Hawaii college of tropical agriculture and human resources.

     (e)  The department of education and department of agriculture shall publish the requirements and application procedures for the farm to school grant program on the respective public website of each department.

     (f)  The department of education shall adopt rules pursuant to chapter 91 to implement this section."

     SECTION 2.  Section 141-11, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The Hawaii farm to school program shall be headed by a farm to school coordinator who shall [work]:

     (1)  Work in collaboration with the appropriate stakeholders to address the issues of supply, demand, procurement, and consumption of Hawaii-grown foods in state facilities, primarily education facilities, and take reasonable steps to incorporate more agriculture and nutrition education in schools[.]; and

     (2)  Assist the department of education in the administration of the farm to school grant program under section 302A-  ."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to hire one full-time farm to school grant program coordinator.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to hire one full-time farm to school grant program special fund manager.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $2,000,000 or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to be deposited into the farm to school grant program special fund.

     SECTION 6.  There is appropriated out of the farm to school grant program special fund the sum of $2,000,000 or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for the farm to school grant program to provide grants to farmers participating in the Hawaii farm to school program.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 7.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 8.  This Act shall take effect on July 1, 2051.
