A BILL FOR AN ACT

 

 

relating to fishing nets.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 188, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§188-    Fishing net identification tag; required.  (a)  No fishing net shall be used in state waters without a permanently affixed identification tag specified and approved or issued by the department of land and natural resources.

     (b)  Identification tags shall be clearly and indelibly marked with the contact information of the fishing net's owner, including the owner's:

     (1)  Name;

     (2)  Telephone number; and

     (3)  Electronic mail address, if applicable.

     (c)  Any fishing net that does not have identification tags shall be subject to immediate seizure and subject to any law or rule.

     (d)  The department shall adopt rules pursuant to chapter 91 to implement this section.

     (e)  For the purpose of this section, "fishing net" means a net that is placed into water outside the direct control of a person for the purpose of taking fish; provided that "fishing net" includes bag nets, fence nets, gill nets, and lay nets and does not include hand nets, landing nets, or throw nets."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
