A BILL FOR AN ACT

 

 

RELATING TO PRIVATE FLIGHT SCHOOLS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 305J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§305J-    Private flight schools; regulation or authorization.  The department, at its discretion, may regulate or authorize a private flight school that:

     (1)  Is physically present in the State;

     (2)  Is certified by the Federal Aviation Administration;

     (3)  Offers a degree or instruction that qualifies an individual to take federal aviation administration flight qualification examinations;

     (4)  Offers an advanced certificate for flight instructors;

     (5)  Requests department authorization; and

     (6)  Meets any other requirements established by the department by rule,

for the purposes of qualifying the flight school to participate in loan programs established pursuant to Title IV of the Higher Education Act of 1965, as amended."

     SECTION 2.  Section 305J-6, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  To administer this chapter, the department shall:

     (1)  Maintain a list of the private colleges or universities, seminaries, and religious training institutions that have been authorized and make this list available to the public;

     (2)  Maintain a list of the states with which the director has entered into a post-secondary education authorization reciprocity agreement and make this list available to the public; and

     (3)  Receive, arbitrate, investigate, and process complaints[.]; provided that this paragraph shall not apply to complaints against a flight school authorized and regulated under section 305J-     ."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2051.

Description:

Requires the Department of Commerce and Consumer Affairs to authorize and regulate private flight schools that meet certain requirements.  Relieves the Department of the duty to receive, arbitrate, investigate, and process complaints made against flight schools.  (HB190 HD2)
