A BILL FOR AN ACT

 

 

relating to hunting.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 183D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§183D-    Hawaii apprentice hunting license program; established.  (a)  There is established the Hawaii apprentice hunting license program.  The program shall provide participants with the opportunity to learn if the participant is interested in obtaining a hunting license pursuant to section 183D-22.  A Hawaii apprentice hunting license shall not be a prerequisite to obtain a hunting license under section 183D-22.

     (b)  A Hawaii apprentice hunting license shall be issued to a person who:

     (1)  Is ten years of age or older; and

     (2)  Will be mentored by an adult who is twenty-one years of age or older who holds a valid hunting license under this part.

     (c)  The holder of a Hawaii apprentice hunting license shall carry the license on the holder's person at all times while engaged in hunting.  The holder shall also be accompanied by and under supervision of the mentor required pursuant to subsection (b)(2).  While in the field, there shall not be more than two Hawaii apprentice hunting license holders under the mentorship and supervision of any single mentor.  For Hawaii apprentice hunting license holders engaged in hunting with the use of firearms, there shall be no more than two firearms in the field between the mentor and the supervised apprentice or apprentices.

     (d)  If the holder of a Hawaii apprentice hunting license desires to obtain a hunting license, the holder shall meet the requirements pursuant to section 183D-22.

     (e)  A Hawaii apprentice hunting license shall be valid for the duration of a current hunting license year when applied for; provided that the license shall be renewable for one additional license year.

     (f)  The license fee for a Hawaii apprentice hunting license shall be:

     (1)  $10 for any person who has resided in the State for one year or longer, or who is a member of the armed forces of the United States on active duty; and

     (2)  $95 for all other persons."

     SECTION 2.  Section 183D-21, Hawaii Revised Statutes, is amended to read as follows:

     §183D-21  Hunting licenses required.  No person shall hunt, pursue, kill, or take any game bird or mammal without first procuring a hunting license[;] or a valid Hawaii apprentice hunting license pursuant to section 183D-  ; provided that section 183D-32 to the contrary notwithstanding, no license shall be required of persons who may be authorized in writing by the board to destroy game birds or game mammals injurious to forest growth or agriculture, or that constitute a nuisance or a health hazard."

     SECTION 3.  Section 183D-22, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  A hunting license shall be issued to a person by an agent of the department upon:

     (1)  Written application in the form prescribed by the department;

     (2)  Payment of a hunting license fee or any other hunting related fee the board may require as provided in this chapter; except that payment of the fee shall be waived for any employee of the department who is required to have a license to carry out duties of the department; and

     (3)  Showing of a valid Hawaii hunter education certificate or written exemption issued under section 183D-28 or upon showing proof of completion of an approved hunter education course described in section 183D-28(b)(2)[.]; provided that the holder of a valid Hawaii apprentice hunting license shall be exempt from showing proof of completion of an approved hunter education course.

The application shall require a statement under oath of the applicant's name, address, domicile or residence, length of residence in the State, age, race, height, weight, and color of hair and eyes[.]; provided that for an applicant who holds a Hawaii apprentice hunting license and is under the age of eighteen, the application shall require the legal signatures of the applicant's parents or legal guardian in person at any of the department's division of forestry and wildlife offices."

     SECTION 4.  Section 183D-28, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The department shall establish a hunter education program to provide instruction in hunter safety, principles of conservation, and sportsmanship.  Upon successful completion of the program, the department shall issue to the graduate a hunter education certificate which shall be valid for the life of the person.  This certification shall be rescinded by judicial action upon the conviction of a wildlife and/or firearms violation.  No person shall be eligible for a hunting license unless the person possesses a valid hunter education certificate, valid Hawaii apprentice hunting license, or meets the requirements for exemption provided in subsection (b)(2), and is either:

     (1)  Born after December 31, 1971; or

     (2)  Born before January 1, 1972, and has never been issued a hunting license in the State."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect upon its approval.
