A BILL FOR AN ACT

 

 

relating to homelessness.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  The legislature finds that Hawaii has the highest rate per capita of homelessness of any state in the nation.

The legislature further finds that each state department is responsible for enforcing trespass laws on its own land to prevent illegal homeless encampments.

The purpose of this Act is to establish a pilot program to centralize the enforcement of trespass laws on state property.

SECTION 2.  (a)  There is established a trespass enforcement pilot program within the office of the governor to address illegal homeless encampments on state property.

(b)  The office of the governor shall coordinate and oversee the enforcement of trespass laws on state lands for the purpose of preventing and addressing illegal homeless encampments on state lands.

(c)  The office of the governor may temporarily establish positions to enforce trespassing laws and may manage current employees of state departments for the purposes of enforcing trespassing laws and preventing and addressing illegal homeless encampments.

(d)  The office of the governor shall submit a report of its findings and recommendations on the pilot project, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2020.  The report shall include:

     (1)  The number of trespass citations and warnings given;

     (2)  The number of individuals placed in homeless shelters as the result of activities of the pilot project; and

     (3)  A recommendation on whether the pilot project should be made permanent, modified, or terminated.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2018-2019 for the office of the governor to enforce public trespassing laws on state lands, including lands within the jurisdiction of the department of transportation, department of land and natural resources, and the department of education.

     The sum appropriated shall be expended by the office of the governor for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2018, and shall be repealed on June 30, 2019.
