A BILL FOR AN ACT

 

 

relating to correctional facilities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  Any correctional facility constructed in the State after the effective date of this Act shall include, at a minimum, one building, ward, or wing designed to securely house patients who have been adjudged not responsible for a felony offense on the ground of physical or mental disease, disorder, or defect pursuant to section 704-400, Hawaii Revised Statutes.

     (b)  As used in this section, "correctional facility" includes any structure designed to house persons convicted of a crime, whether the structure is constructed or operated by the State, one of its political subdivisions, or a private entity.

     SECTION 2.  This Act shall take effect upon its approval.
