A BILL FOR AN ACT

 

 

relating to funds used for the settlement of claims.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  The following sum, which was previously appropriated to the department of education through Act 49, Session Laws of Hawaii 2017, is authorized to be expended by the department of education for the purpose of satisfying class counsel's attorney's fees related to the following class action claim against the State or its officers or employees, in the amount set forth:

     E.R.K., et al. v. Department of Education,   $ 1,500,000.00   

     et al., Civil No. 1:10-CV-00436 SOM-KSC,         Settlement

     USDC     

 

     TOTAL:                                     $ 1,500,000.00

 

     The sum authorized to be expended shall be expended by the department of education for the purposes of this Act.

PART II

     SECTION 2.  Of the unencumbered carryover balance of moneys that remain to the credit of EDN150 - special education and student support services as of July 1, 2017, and carried over pursuant to section 37-41.5, Hawaii Revised Statutes, $4,750,000 shall lapse to the credit of the general fund.

     SECTION 3.  All unexpended and unencumbered balances of the appropriation made in this Act as of the close of business on June 30, 2019, shall lapse.

     SECTION 4.  This Act shall take effect upon its approval.
