A BILL FOR AN ACT

 

 

relating to Dairy.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that consumers' food preferences have shifted toward locally-produced food in recent years.  Additionally, many small farms have the capability and desire to offer unpasteurized dairy products to consumers that seek locally-produced dairy products.  However, certain regulations make the access to unpasteurized dairy difficult or prohibited.

     The legislature further finds that thirty states permit some sale or distribution of unpasteurized milk for human consumption, twelve of which permit the sale of unpasteurized milk in retail stores.

     The purpose of this Act is to increase access to dairy products by expressly permitting:

     (1)  The sale of unpasteurized milk; and

     (2)  The establishment of cow share programs.

     SECTION 2.  Chapter 157, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§157-A  Unpasteurized milk sales.  (a)  The offering for sale and sale of unpasteurized milk products in retail stores shall be permitted; provided that a retailer shall not sell unpasteurized milk:

     (1)  Later than one hundred twenty hours after it is milked; or

     (2)  Without a label that warns about the risks of consuming unpasteurized milk, especially to children and the elderly.

     (b)  A producer shall keep a record of the name and address of all persons to which it sells unpasteurized milk.

     (c)  A producer may sell unpasteurized milk for animal consumption.

(d)  As used in this section, "unpasteurized milk" means milk, cream, butter, or other product that includes milk from a cow, goat, or sheep that has:

     (1)  Not been heated; or

     (2)  Been heated:

         (A)  To a temperature; or

         (B)  For a time,

          that is less than what is required for pasteurization under the definition of "pasteurized milk" in section 157-1.

     §157-B  Cow share programs.  Producers may establish cow share programs in which consumers:

     (1)  Purchase a share of a milk-producing cow; and

     (2)  Routinely receive from the producer a portion of milk that is equivalent to the purchased share of the milk-producing cow."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
