A BILL FOR AN ACT

 

 

relating to planning and economic development.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 205, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§205-     Reclassification and transfer of certain agricultural lands.  (a)  Notwithstanding any other law, the legislature, by the adoption of a concurrent resolution approved by a two-thirds vote of each house of the legislature voting separately, may:

     (1)  Reclassify agricultural land with soil classified by the land study bureau's detailed land classification as overall (master) productivity rating class C or D from an agricultural district to an urban district; and

     (2)  Transfer lands reclassified under paragraph (1) to the department of Hawaiian home lands or office of Hawaiian affairs.

     (b)  The value of any land transferred, pursuant to subsection (a), to the office of Hawaiian affairs shall be credited against the pro rata portion of funds derived from the public land trust dedicated for use by the office under sections 10-3 and 10-13.5.

     (c)  For the purposes of this section, the value of the transferred land shall be determined after the land has been reclassified for urban use."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
