A BILL FOR AN ACT

 

 

relating to HIGHWAYS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the original plans for highways on the county of Maui:

     (1)  Included a state-operated highway above the inundation zone in west Maui; and

     (2)  Designated what is now known as route 30, or Honoapiilani highway, as a county-operated highway.

Despite the original plans, route 30 is the only highway in west Maui, is operated by the department of transportation, and is not entirely above the inundation zone.

     The legislature further finds that scenic highways are eligible for federal aid funding.  The legislature believes that transferring route 30 to the county of Maui will allow the county of Maui to apply for federal aid funding for route 30 and will allow the State to divert resources to establish and maintain a highway above the inundation zone in west Maui.

     SECTION 2.  The governor shall transfer ownership in fee simple of route 30, Honoapiilani highway from High street to Honokohau bridge, to the county of Maui for use as a county highway, by December 31, 2017.

     SECTION 3.  This Act shall take effect upon its approval.
