A BILL FOR AN ACT

 

 

PROPOSING AN AMENDMENT OF THE HAWAII CONSTITUTION RELATING TO THE RESIGNATION OF STATE SENATORS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article II, section 7, of the Constitution of the State of Hawaii to allow for state senators to be eligible to run as candidates for another office without having to immediately resign from their senatorial positions and have their terms instead terminate on the next occurring general election.

     SECTION 2.  Article II, section 7, of the Constitution of the State of Hawaii is amended to read as follows:

"RESIGNATION FROM PUBLIC OFFICE

     Section 7.  Any elected public officer shall resign from that office before being eligible as a candidate for another public office, if the term of the office sought begins before the end of the term of the office held[.]; provided that in the case of a state senator seeking an office that begins before the senator's term ends, the state senator seeking to be eligible as a candidate for the other public office may remain in office as a senator until the next occurring general election, or upon being duly elected and certified to the other public office, whichever occurs first."

     SECTION 3.  The question to be printed on the ballot shall be as follows:

     "Shall the state constitution's public office resignation provision, which requires that any elected public officer resign from that office before being eligible as a candidate for another public office if the term of the office sought begins before the end of the term of the office held, be amended to allow a sitting state senator seeking another public office that begins before the senator's term ends, to remain in office as a senator until the next occurring general election, or upon the senator being duly elected and certified to the other public office, whichever occurs first?"

     SECTION 4.  Constitutional material to be repealed is bracketed and stricken.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
