RELATING TO SERVICE IN NON-CRIMINAL PROCEEDINGS.

Authorizes service of notice and process by electronic mail in non-criminal and administrative proceedings, with certain exceptions.  Extends the time for response after service by mail to at least five days.

RELATING TO CRIMINAL PROCEDURE.

Creates procedural and administrative requirements for law enforcement agencies for eyewitness identifications of suspects in criminal investigations.  Grants a defendant the right to challenge any eyewitness identification to be used at trial in a pretrial evidentiary hearing.  Effective January 1, 2020.

Provides authority for the Hawaii Criminal Justice Data Center to set and collect fees for services provided.

RELATING TO CRIME VICTIM COMPENSATION FOR MENTAL HEALTH SERVICES.

Authorizes crime victim compensation for mental health services for survivors in cases involving a death and for children who witness domestic violence.

RELATING TO RESTITUTION FOR VICTIMS OF CRIME.

Clarifies that reimbursement to crime victims includes lost wages, mental health treatment, and therapy.

RELATING TO THE JUDICIARY.

Requires the Judiciary to implement a program that offers any qualifying person the option to fulfill any court-ordered financial obligation through:  (1) installment payments in a payment plan; or (2) the performance of community service.  Prohibits the courts from taking certain actions against a person solely because of that person's inability to pay if the person has entered into and is in compliance with the programs.  Reinstates driver's licenses that were suspended for nonpayment under certain circumstances.

RELATING TO LOBBYISTS.

Removes statutory remnants from when violations of the lobbyist law resulted in criminal penalties.  Allows the state ethics commission to assess an administrative fine pursuant to a settlement agreement.

Clarifies the State Ethics Code by clarifying provisions regarding gift disclosure statements, retention of financial disclosure statements, and ethics training.

RELATING TO LOBBYISTS.

Prohibits former legislators and executive branch employees subject to senate confirmation from engaging in lobbying for 24 months after termination of employment as a legislator or executive branch employee.  Effective 7/1/2021.

RELATING TO CAMPAIGN FINANCE.

Establishes an exemption from the prohibition against using election campaign funds to make charitable donations or to award scholarships during the period from the filing of nomination papers to the date of the general election for candidates who are already declared elected to office after running unopposed in an election or who would be unopposed in the general election.

Status

RELATING TO CAMPAIGN FINANCE.

Establishes that a photograph of a person used in campaign shall be reported as an in-kind contribution to the respective candidate or noncandidate committee.  Imposes a fine on a committee that uses a photograph in a campaign without the photographed person's authorization.  Classifies any independent expenditure as a contribution to a candidate or as a contribution to each opposing candidate.  Requires any advertisement by a noncandidate committee that makes only independent expenditures to disclose all contributors for the advertisement.

RELATING TO ELECTIONEERING COMMUNICATIONS.

Amends the definition of "disclosure date" in section 11-341(d), HRS, to mean the date when the electioneering communication is publicly distributed.  Expands the definition of "electioneering communication" in section 11-341(d), HRS, to apply to advertisements sent by any mail rate and those that are expenditures of an organization.  Repeals section 11-341(e), HRS.

Status

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW.

Increases the fine that may be assessed, for campaign spending law violations, against a noncandidate committee making only independent expenditures and that has received at least 1 contribution of more than $10,000, or spent more than $10,000 in an election period.  Allows the Campaign Spending Commission to order that payment of a fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee.

Status

RELATING TO INTERNAL REVENUE CODE SECTION 501(C)(4) ORGANIZATIONS.

Requires an organization that is exempt from federal taxation under IRC section 501(c)(4) to submit semi-annual reports to the campaign spending commission if the organization expends funds to make communications that advocate for or against elected officials or their positions on government actions.

PROPOSING AN AMENDMENT TO THE HAWAII CONSTITUTION, ARTICLE II, SECTION 1, TO EXPAND THE RIGHT TO VOTE.

Lowers the right to vote in state and local elections to those who are sixteen years of age or older per the Hawaii Constitution.

Requires vacancies in the offices of United States Senator, State Senator, and State Representative to be filled by special election.

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.
