A BILL FOR AN ACT

 

 

RELATING TO TRANSITIONAL HOUSING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the area beneath the Nimitz viaduct on the island of Oahu is owned by the State.  The legislature also finds that this area is currently occupied by homeless individuals and families.  The legislature acknowledges that the State has spent millions of dollars to clear this area of its homeless population; however, the legislature further acknowledges that the area's homeless population moved back to the area following the clearing.  The legislature further finds that this area is located a considerable distance away from any residential areas, but is located near transitional shelters.

     Accordingly, the purpose of this Act is to require the department of human services to establish, construct, and operate transitional shelters comprising micro units beneath the Nimitz Viaduct, as well as any other appropriate areas on the island of Oahu, including but not limited to any viaduct along interstate H-1 or interstate H-2.

     SECTION 2.  (a)  Notwithstanding any provision of law to the contrary, the department of human services shall establish, construct, and operate transitional shelters comprising micro units in the area beneath the Nimitz viaduct on the island of Oahu and any other appropriate areas on the island of Oahu, including but not limited to any viaduct along interstate H-1 or interstate H-2 on the island of Oahu that may be suited for transitional shelters.

     (b)  Any procurements conducted to carry out the purposes of this Act shall be exempt from chapters 103D and 103F, Hawaii Revised Statutes.

     (c)  The department of human services shall submit a report on the establishment of the transitional shelter to the legislature no later than twenty days prior to the convening of the regular session of 2020.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for the establishment, construction, and operation of transitional shelters beneath the Nimitz viaduct on the island of Oahu and any other appropriate areas on the island of Oahu, including but not limited to any viaduct along interstate H-1 or interstate H-2.

     The sums appropriated shall be expended by Hawaii housing and finance development corporation for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2019.
