A BILL FOR AN ACT

 

 

RELATING TO SUBSTANCE ABUSE TREATMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that a smoking cessation program to prohibit smoking at substance abuse treatment facilities that includes good health and wellness practices for recovery from substance abuse can be beneficial.  However, the impacts of a smoking ban in these facilities on facility residents must be coupled with appropriate treatment services and supports as part of a treatment regimen to transition facility residents to a smoke-free environment.

     The purpose of this Act is to require the department of health to convene a working group to study and examine the effects of prohibiting smoking and using tobacco products on the premises of substance abuse treatment facilities.

     SECTION 2.  (a)  The department of health shall convene a working group to study and examine the effects of prohibiting smoking and using tobacco products on the premises of substance abuse treatment facilities.  The executive director of the Hawaii public housing authority and the executive director of Habilitat, or the respective designee of each executive director, shall be part of the working group.

     (b)  The working group shall study and examine the effects of prohibiting smoking and using tobacco products on the premises of substance abuse treatment facilities, including treatment for tobacco dependence by residents; whether a smoking ban supports or undermines treating tobacco dependence and dependence on other substances; any services and supports that may be necessary to transition substance abuse treatment facility residents to a smoke-free environment; and any barriers a smoking and tobacco use prohibition may have on facility residents' efforts to quit smoking.

     (c)  The department of health shall submit the working group's report that includes its findings and recommendations, including proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2021.

     SECTION 3.  This Act shall take effect on December 31, 2059.

Description:

Requires DOH to convene a working group that includes the participation of the HPHA executive director or designee, to study and examine the effects of prohibiting smoking and using tobacco products on the premises of substance abuse treatment facilities.  Requires DOH to submit a report to the legislature prior to the 2021 regular session.  Takes effect 12/31/2059.  (HD1)
