A BILL FOR AN ACT

 

 

relating to the university of hawaii.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  According to article X, section 4, of the Hawaii State Constitution, the "State shall provide for a Hawaiian education program consisting of language, culture and history in the public schools."  This commitment was recently reaffirmed by the Hawaii Supreme Court in their August 13, 2019, ruling on Clarabal v. Department of Education.  In that ruling, the Hawaii Supreme Court held "that the Hawaiian education provision was intended to require the State to institute a program that is reasonably calculated to revive the Hawaiian language."

     The purpose of this Act is to appropriate funds to support the preservation and cultivation of the Hawaiian language by providing scholarships to students pursuing Hawaiian language degrees through the University of Hawaii's Hawaiian language programs.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2020-2021 for scholarships for students pursuing a Hawaiian language degree at the Kawaihuelani center for Hawaiian language at the University of Hawaii at Mānoa.

     The sum appropriated shall be expended by the University of Hawaii for the purposes of this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 for scholarships for students pursuing a Hawaiian language degree at the Ka Haka Ula O Keelikōlani college of Hawaiian language.

     The sum appropriated shall be expended by the University of Hawaii for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2020.
