A BILL FOR AN ACT

 

 

RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§200‑     Water sports equipment decal program.  (a)  There is established within the department for administrative purposes a water sports equipment decal program.

     (b)  The program shall provide a process for owners to voluntarily register water sports equipment with the department and receive decals to facilitate the confirmation of the registered owner's safety when that equipment is recovered unaccompanied and the return of the recovered equipment to the registered owner.  Upon initial registration by an owner or transferee, the chairperson shall require:

     (1)  Proof of ownership; and

     (2)  Completion of a water sports equipment decal application form, which shall include the owner's name, address, contact information, and any other information the department deems necessary to effectuate this section.

     (c)  Upon submission of a completed water sports equipment registration application form, the chairperson shall mail a water sports equipment decal and certificate of registration to the registered owner.  The water sports equipment decal shall be:

     (1)  Furnished by the department free of charge;

     (2)  In a form as the chairperson shall prescribe; and

     (3)  Waterproof.

     (d)  The registered owner shall affix the water sports equipment decal to each registered piece of water sports equipment in a manner that provides a clearly visible and unobstructed view of the decal.

     (e)  Any registered owner who transfers ownership of any water sports equipment registered pursuant to this section shall notify the department within thirty calendar days of the transfer.  Any person who violates this subsection shall be fined not more than $100 for each violation.  Each registered piece of water sports equipment that is transferred without notice to the department pursuant to this subsection shall constitute a separate violation.

     (f)  The department shall adopt rules pursuant to chapter 91 to effectuate the purposes of this section.

     (g)  For purposes of this section, "water sports equipment" means personal recreational equipment used for water sports activities, including kayaks, dive floats, thrill craft, stand-up paddleboards, surfboards, or any other equipment as determined by the department.  Water sports equipment shall not include any equipment used for commercial purposes."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 to establish a water sports equipment decal program.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.
