A BILL FOR AN ACT

 

 

RELATING TO SOLID WASTE MANAGEMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State has a duty to protect the environment, economy, and public health of its people.  Act 324, Session Laws of Hawaii 1991, also known as the Hawaii Integrated Solid Waste Management Act, established the framework for statewide governmental coordination of solid waste management planning through the creation of the office of solid waste management in the department of health.  The office is tasked with leading the State's solid waste management planning by promoting source reduction, recycling, and bioconversion, including home composting, through the provision of a comprehensive, innovative, and effective statewide public education and awareness program concerning the value of source reduction and recycling, and the way the public can participate in these areas.

     The legislature further finds that many state and local governments have recycling mandates or landfill prohibitions to encourage waste diversion; however commercial recyclers in the State suffer from low profit margins, causing recyclable and compostable material to go to landfills or to Asia or the United States mainland to be recycled.  The office of solid waste management is required to promote the use of enterprise zones in each county to support source reduction, recycling, and bioconversion-type businesses, but there remains a lack of these types of businesses in the State.

     The legislature notes that the director of health has effective enforcement and penalty provisions to carry out the provisions of this Act if necessary.

     The purpose of this Act is to:

     (1)  Require that residential and commercial solid waste be separated by source to be processed at appropriate facilities;

     (2)  Require counties to update their integrated solid waste management plans;

     (3)  Establish a new waste stream reduction goal for 2030; and

     (4)  Appropriate funds to each county to help subsidize their waste management programs.

     SECTION 2.  Chapter 342G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§342G-     Source separation of waste required.  (a)  All residential and commercial solid waste in the State shall be separated into appropriate containers based on source, according to green waste, compostable, recyclable, and trash, to be processed or disposed of at the appropriate processing or disposal facility.

     (b)  Each county shall provide appropriate containers to residential and commercial properties to make solid waste diversion convenient.  The containers shall be:

     (1)  An appropriate number and size in light of the recyclable, compostable, and landfill quantities to be anticipated at a location; and

     (2)  Color coded to identify the type of solid waste contained and meet any additional design criteria established by the office."

     SECTION 3.  Section 342G-3, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  It is the goal of the State to reduce the solid waste stream prior to disposal by:

     (1)  Twenty-five per cent by January 1, 1995; [and]

     (2)  Fifty per cent by January 1, 2000; and

     (3)  Eighty per cent by 2030;

through source reduction, recycling, and bioconversion.  Where feasible, the office shall establish other state goals for specific commodities, recognizing market considerations."

     SECTION 4.  By January 1, 2021, each county shall submit a revised integrated solid waste management plan to the office of solid waste management, pursuant to the requirements of chapter 342G, Hawaii Revised Statutes.

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 to assist the counties in the implementation of their solid waste management programs, to be allocated as follows:

     County of Hawaii                       $          

     County of Kauai                        $          

     County of Maui                         $          

     City and county of Honolulu             $          

     The sum appropriated shall be expended by each respective county for the purposes of this Act.

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect on July 1, 2050.
