A BILL FOR AN ACT

 

 

relating to safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Puu Kekaa, also known as Black Rock, on the island of Maui, is frequently the site of drownings, spinal cord injuries, and other ocean trauma incidents.  From 2014 through 2018, there were fifteen fatal drownings at Puu Kekaa Beach.

     The legislature also finds that three out of four of the drowning victims at Puu Kekaa were visitors to the State, threatening Hawaii's reputation as a safe place to live and visit.  The legislature further finds that the safety of the public is being neglected at Puu Kekaa, and there is immediate need for lifeguard services in this area.

     Accordingly, the purpose of this Act is to appropriate funds to provide lifeguard services and access to state land at Puu Kekaa on the island of Maui so the public may safely enjoy the State's waters.  Funding and staffing for services, to include a lifeguard tower, shall remain the responsibility of the county in this state-county partnership.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2020-2021 to provide access to state land for lifeguards at Puu Kekaa on the island of Maui, an area under the jurisdiction of the department of land and natural resources.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2020.
