Sir:

 

     Your Committee on Water, Land, & Hawaiian Affairs, to which was referred H.B. No. 2602 entitled:

 

"A BILL FOR AN ACT RELATING TO AGRICULTURAL LANDS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Amend the definition of "farm dwelling" that applies to allowed uses in the agricultural district; and

 

     (2)  Amend certain land subdivision and condominium property regime laws related to agricultural land, as recommended by the Office of Planning in its study of subdivision and condominium property regimes on agricultural lands on Oahu conducted pursuant to Act 278, Session Laws of Hawaii 2019.

 

     Your Committee received testimony in support of this measure from the Department of Agriculture, Office of Planning, Department of Planning and Permitting of the City and County of Honolulu, Hawaii Cattlemen's Council, Hawaii Farm Bureau, and two individuals.  Your Committee received comments on this measure from the Department of Taxation.

 

     Your Committee finds that allowing county input in the condominium property regime process involving agricultural lands allows the county to timely assess the availability of necessary infrastructure.  County input may also allow the identification of concerns about potential effects on environmentally or culturally significant resources prior to the piecemeal sale of property. 

 

     Your Committee has amended this measure by changing its effective date to July 1, 2050, to encourage further discussion.

 

As affirmed by the record of votes of the members of your Committee on Water, Land, & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2602, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2602, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
