RELATING TO LAND RECORDATION.

Clarifies the data requirements for land recordation on land deregistered by the land court other than fee simple time share interests.

RELATING TO LANDOWNER LIABILITY.

Provides liability protections for public and private landowners who expressly allow access and use of their land to practitioners of Native Hawaiian traditional and customary practices.

RELATING TO SEARCH AND RESCUE.

Requires government entities to seek reimbursement for search and rescue expenses for persons who require rescue after leaving a hiking trail to enter a prohibited area or hiking on a trail closed to the public.

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.

Amends the nominating authority of the representatives of the Heeia community development district, Kalaeloa community development district, and Kakaako community development district on the Hawaii community development authority.

RELATING TO NATIVE HAWAIIAN AFFAIRS.

Requires the governor to appoint the governor's coordinator on Native Hawaiian affairs to coordinate responses to issues that impact Native Hawaiians and Native Hawaiian culture across state departments and agencies.

RELATING TO HISTORIC PRESERVATION.

Requires the Department of Land and Natural Resources to establish a citizen complaint intake process and prepare related informational material for dissemination and posting.  Clarifies that failure to comply with certain advisement or approval processes shall constitute a violation of chapter 6E, Hawaii Revised Statutes.  Authorizes the State Historic Preservation Division to issue an order to stop work immediately in the event of a failure to comply with certain advisement or approval processes.  Makes any violator responsible for the costs of any site inspection and any recommended mitigation or restoration measures.  Increases the maximum civil and administrative fines for violations of historic preservation review requirements.  Requires the Department of Land and Natural Resources to maintain and publish a list of certain violators.  Authorizes the expenditure of moneys in the historic preservation special fund for certain costs relating to the enforcement of chapter 6E, Hawaii Revised Statutes.

Status

RELATING TO THE KAHOOLAWE ISLAND RESERVE COMMISSION.

Appropriates funds to the Department of Land and Natural Resources for the operations of the Kahoolawe Island Reserve Commission and for 2 full-time equivalent positions on the Commission.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·    Testifier's name with position/title and organization;

·    The Committee(s) to which the comments are directed;

·    The date and time of the hearing; and

·    Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

 

Submit testimony in ONE of the following ways:

FAX:     For testimony less than 5 pages in length, transmit to 808-586-8484 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or

WEB:    For testimony less than 20MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

If during the course of the hearing it appears there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three-minutes.  This three-minute policy will be enforced to ensure fairness and adequate consideration to all bills.
