HOUSE CONCURRENT

RESOLUTION

 

 

AUTHORIZING THE ISSUANCE OF A PERPETUAL, NON-EXCLUSIVE EASEMENT COVERING PORTIONS OF SUBMERGED LANDS AT MAUNALUA, OAHU, HAWAII, FOR THE CONSTRUCTION AND MAINTENANCE OF A ROCK GROIN TO SLOW THE RATE OF SEDIMENT DEPOSITION IN THE entrance channel of the HAWAII KAI MARINA.

 

 


     WHEREAS, the Hawaii Kai Marina Community Association (HKMCA) is responsible for the maintenance of the entrance channel between the privately-owned Hawaii Kai Marina and Maunalua Bay; and

 

     WHEREAS, in 2013, HKMCA reconstructed the temporary sandbag groin on the eastern side of the Hawaii Kai Marina entrance channel to retain sand and slow the rate of sediment deposition in the channel; and

 

     WHEREAS, the performance of the sandbag groin has been monitored and shown to effectively reduce the rate of sediment deposition in the Hawaii Kai Marina entrance channel; and

 

     WHEREAS, around March 2016, HKMCA began working with the Office of Conservation and Coastal Lands on the proposed Hawaii Kai Marina Entrance Channel groin replacement project to remove the temporary sandbag groin and construct a permanent rock groin in its place; and

 

     WHEREAS, the Final Environmental Assessment and Finding of No Significant Impact for the Hawaii Kai Marina Entrance Channel groin replacement project were published on August 8, 2017; and

 

     WHEREAS, on August 30, 2018, the Board of Land and Natural Resources (Board) approved the application of a Conservation District Use Permit for the Hawaii Kai Marina Entrance Channel groin replacement project; and

 

     WHEREAS, on June 12, 2020, under agenda item D-7, the Board approved the issuance of a perpetual, non-exclusive easement to HKMCA for the replacement of the existing deteriorating sandbag groin with a new, larger, and permanent rock rubble mound revetment and groin; and

 

     WHEREAS, the grantee shall pay the State the fair market value of the easement as consideration of the use of state submerged lands to be determined by independent appraisal; and

 

     WHEREAS, section 171-53, Hawaii Revised Statutes, requires the prior approval of the Governor and prior authorization of the Legislature by concurrent resolution to lease state submerged lands; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, the Senate concurring, that the Board of Land and Natural Resources is authorized to issue a perpetual, non-exclusive easement covering portions of state submerged lands seaward of Tax Map Key Nos: (1) 3-9-008:035 and (1) 3-9-002:029 and Tax Map Key: (1) 3-9-002:seaward of Kalanianaole Highway near the bridge at Maunalua, Oahu, Hawaii, for the construction and maintenance of a rock groin to slow the rate of sediment deposition into entrance channel of the Hawaii Kai Marina; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
