HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE CONVENING OF A WORKING GROUP TO DISCUSS THE ROLE OF THE AUTHORIZER, ITS RELATIONSHIP WITH CHARTER SCHOOLS, THE ACCOUNTABILITY FOR THE USE OF PUBLIC FUNDS, AND WHETHER OR NOT LEGISLATION IS REQUIRED TO EFFECTUATE ANY DESIRED CHANGES.

 

 


     WHEREAS, the Hawaii State Public Charter School Commission (Charter Commission) has faced questions on the role of the authorizer and its relationship with charter schools; and

 

     WHEREAS, it is unclear whether the unresolved questions about the Charter Commission's authority should be addressed via the Legislature through the enactment of laws or by administrative rulemaking; and

 

     WHEREAS, there is a need to clarify the purpose and intent of charter school authorizers; and

 

     WHEREAS, the need for public accountability of public funds must be balanced with the authority for the charter school to educate our keiki; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, the Senate concurring, that the following are requested to convene as members of the Charter School Authorizers Working Group:

 

     (1)  The Chairperson of the Senate Education Committee, or their designee, who shall serve as co-chair;

 

     (2)  The Chairperson of the House Education Committee, or their designee, who shall serve as co-chair;

 

     (3)  The Chairperson of the Board of Education, or their designee;

 

     (4)  The Chairperson of the Charter Commission, or their  designee;

 

     (5)  The Executive Director of the Charter Commission, or their designee;

 

     (6)  A representative from the Department of the Attorney General;

 

     (7)  A representative from the Hawaii State Ethics Commission;

 

     (8)  A representative of a conversion and Hawaiian immersion school;

 

     (9)  A representative of a charter school located on Oahu;

 

    (10)  A representative of a charter school located on a neighbor island; and

 

    (11)  Additional members as requested by the co-chairs of the committee; and

 

     BE IT FURTHER RESOLVED that the Charter School Authorizers Working Group is requested to examine the following:

 

     (1)  Any administrative rules the Charter Commission should promulgate to effectuate a productive relationship between the authorizer and charter school that results in positive educational outcomes; and

 

     (2)  Any legislation the Legislature should enact to accomplish the Charter Commission's goals; provided that any recommendations for legislation should include national best practices as applicable to Hawaii's public charter school system and focus on positive student outcomes in public education; and

 


     BE IT FURTHER RESOLVED that the Charter School Authorizers Working Group is requested to meet in May, July, September, and November in 2021; and

 

     BE IT FURTHER RESOLVED that the Charter School Authorizers Working Group is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2022; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Charter Commission, Executive Director of the Charter Commission, and Chairperson of the Board of Education.
