HOUSE RESOLUTION

 

 

requesting the Hawaii Civil Rights Commission TO declare that the commission does not support discrimination and right of access restrictions based on COVID-19 vaccine status or immunity test results.

 

 

 


     WHEREAS, any medical decision is a personal and sensitive choice; and

 

     WHEREAS, any person may decline an invasive medical test for health, personal, or other reasons; and

 

     WHEREAS, vaccines of any kind, including those formulated for the coronavirus disease 2019 (COVID-19), are invasive medical tests; and

 

     WHEREAS, numerous people have suffered adverse medical effects from invasive medical tests, including vaccines; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, that the Hawaii Civil Rights Commission is requested to declare that the Commission does not support discrimination and right of access restrictions based on COVID-19 vaccine status or immunity test results; and

 

     BE IT FURTHER RESOLVED that no person or entity in the State should:

 

     (1)  Provide to, or deny, an individual any disposition, service, financial aid, or benefit that is different from, or is provided in a different manner to, a disposition, service, financial aid, or benefit provided to a similarly situated individual having a different COVID-19 vaccine status or immunity test result;

 

     (2)  Subject an individual to segregation or separate treatment based on the individual's COVID-19 vaccine status or immunity test results;

 

     (3)  Restrict an individual's enjoyment of any advantage or privilege enjoyed by others receiving a similar disposition, service, financial aid, or benefit based on an individual's COVID-19 vaccine status or immunity test results;

 

     (4)  Treat an individual differently from others in determining whether the individual satisfies any admission, enrollment, quota, eligibility, membership, or other requirement or condition of any disposition, service, financial aid, function, or benefit based on an individual's COVID-19 vaccine status or immunity test results;

 

     (5)  Deny an individual any opportunity afforded to a similarly situated individual having a different COVID-19 vaccine status or immunity test result; or

 

     (6)  Afford an individual an opportunity that is different from the opportunity afforded to a similarly situated individual having a different COVID-19 vaccine status or immunity test result; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Governor, Lieutenant Governor, and Executive Director of the Hawaii Civil Rights Commission.
