RELATING TO DEFERRED DEPOSITS. Reduces the maximum fee a check casher may charge under a payday loan agreement for deferring the deposit of a check from fifteen per cent to seven per cent of the face value of the check.

RELATING TO CONSUMER PROTECTION. Proposed HD1: Transitions from lump sum deferred deposit transactions to installment-based small dollar loan transactions. Specifies various consumer protection requirements for small dollar loans. Beginning 1/1/2023, requires licensure for small dollar lenders that offer small dollar loans to consumers. Specifies licensing requirements for small dollar lenders. Authorizes the division of financial institutions to appoint 2.0 FTE examiner positions, funded via the compliance resolution fund, to carry out the purposes of the small dollar installment loan program. Requires check cashers to be registered with DCCA and to offer a voluntary payment plan to customers under certain circumstances. Establishes the terms of voluntary payment plans. Clarifies that a customer may only have one outstanding deferred deposit transaction from any source. Amends notices to customers required of check cashers. Removes the exemption for persons engaged in the bona fide retail sale of goods or services. Requires the division of financial institutions of the DCCA to conduct an analysis of the regulation of payday lenders and deferred deposit agreements in the State. Effective 7/1/2022.

RELATING TO INCREASING THE ESTATE TAX. Lowers the exclusion amount of Hawaii's estate tax to $1,000,000. Applicable to decedents dying or taxable transfers occurring after 12/31/2020.

RELATING TO THE DEFINITION OF PROPERTY. Updates the definition of "property" to expressly include intellectual property or property stored in an electronic medium, for purposes of prosecuting property crimes.

RELATING TO DISPOSITION OF WATER LICENSES BY THE BOARD OF LAND AND NATURAL RESOURCES. Clarifies the conditions and manner in which the board of land and natural resources may dispose of water by license. Effective 1/1/2050. (HD1)

RELATING TO THE TAKING OF MARINE LIFE. Clarifies that a valid commercial marine vessel license shall satisfy the commercial marine license requirement for all persons taking marine life for commercial purposes aboard a validly licensed vessel. Requires any person who provides fishing charter services to obtain a commercial marine license. Effective 1/1/2050. (HD1)

RELATING TO LEASE EXTENSIONS ON PUBLIC LAND. Authorizes the Board of Land and Natural Resources to extend certain leases of public lands for commercial, industrial, resort, mixed-use, or government use upon approval of a proposed development agreement to make substantial improvements to the existing improvements. Effective 1/1/2050.

RELATING TO BROADBAND. Establishes the Hawaii broadband office within the Hawaii technology development corporation. Establishes the position of state broadband strategy officer. Renames the broadband assistance advisory council as the broadband advisory council and amends its purpose and membership. Requires the chief executive officer of the Hawaii technology development corporation to convene and chair the broadband advisory council. Appropriates funds. Effective 7/1/2050. (HD1)

RELATING TO BROADBAND SERVICE INFRASTRUCTURE. Establishes the broadband infrastructure grant program to award grants to applicants to extend deployment of infrastructure used to provide broadband service to unserved areas of the State. Amends the Hawaii technology loan revolving fund to change it to the Hawaii broadband infrastructure fund, including the types of funds deposited into the fund. Authorizes the issuance of general obligation bonds for the broadband infrastructure grant program. Effective 7/1/2050. (HD1)

RELATING TO ADVANCED PRACTICE REGISTERED NURSES. Amends provisions concerning fitness to proceed examinations in criminal proceedings to include qualified advanced practice registered nurses or advanced practice registered nurses with prescriptive authority who hold an accredited national certification in an advanced practice registered nurse psychiatric specialization.

RELATING TO GREENHOUSE GAS EMISSIONS. Convenes a Sustainable Aviation Fuel Task Force within the Hawaii State Energy Office to develop a state action plan to reduce the greenhouse gas intensity of international air transportation from Hawaii. Effective 7/1/2050. (HD1)

RELATING TO CARBON OFFSETS. Establishes procedures for the department of transportation, in consultation with the office of planning, to assist and enable a person to voluntarily purchase a verified carbon offset for carbon dioxide emissions resulting from the person's air travel to or from an airport in the State. RELATING TO MOPEDS. Prohibits a retailer from selling or offering for sale combustion engine-powered mopeds beginning January 1, 2023. Effective 7/1/2050. (HD1)

RELATING TO GROUND TRANSPORTATION. Establishes goals for the State to reduce emissions that cause climate change and build energy efficiencies across all sectors, including establishing a clean ground transportation target for light duty vehicles. Prohibits the sale of new motor vehicles that are solely powered by fossil fuels and designed for personal use beginning , , by motor vehicle dealers and salespersons. Effective 7/1/2050. (HD1)

RELATING TO ROOFTOP SOLAR INSTALLATION. Beginning 1/1/2022, prohibits the issuance of building permits for new single-family dwellings that are part of a development of twenty or more dwellings and do not include a rooftop photovoltaic energy generating system, unless a variance is granted. Effective 7/1/2050. (HD1)

RELATING TO INTELLECTUAL PROPERTY. Requires the University of Hawaii to include in certain employment agreements that address intellectual property rights a condition requiring the employees to make a good faith effort to sell or license intellectual property to a farmer or agricultural producer within the State prior to selling or licensing the intellectual property to an entity outside the State. Effective 7/1/2060. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
