Status

RELATING TO PROCUREMENT.

Requires procurement officers to complete periodic performance evaluations of certain contractors.  Establishes factors to be included in any evaluation, consideration, or review of past performance, and ratings standards for those factors.  Requires past performance to be factored into future bid selection of contractors for certain contracts.  Requires past performance to be considered in all sole source procurement and any competitive sealed contracts that exceeds the small purchase threshold.  Requires the state procurement office to submit preliminary and final reports to the legislature.  Repeals 6/30/2026.

Status

RELATING TO PROCUREMENT.

Establishes the subcontractor listing pilot program to be conducted by the department of accounting and general services.  Requires a report to the legislature.

HB 1212

Status

RELATING TO PUBLIC-PRIVATE PARTNERSHIPS.

Establishes the office of public-private partnerships and the position of state public-private partnerships coordinator.  Adds design-build-operate-maintain and design-build-finance-operate-maintain project delivery methods to the Procurement Code and related conditions and requirements.  Appropriates funds.

HB 1214

Status

RELATING TO PROCUREMENT.

Allows a bidder of a public works construction project to clarify and correct certain information regarding subcontractors for up to two hours after bid closing.  Mandates a two hour waiting period after bid closing before construction bids can be opened.  Prohibits bid shopping and bid peddling for the competitive sealed bidding process.  Requires public procurement construction bids to list subcontractors and joint contractors only for contracts with an unspecified total value; provided that bids lacking this list may be accepted if in the State's best interest and the value of the work to be performed by the joint contractor or subcontractor is equal to or less than an unspecified percent of the total bid amount.  Repeals 7/1/2023.

HB 1325

Status

RELATING TO THE PROCUREMENT CODE.

Requires public contractors to obtain insurance to cover at least half of a project's construction costs to the State, to provide funds for curing construction defects discovered within five years after the completion of the contract.  Authorizes the State to institute an action against the contractor for the total costs of curing those defects.

HB 1355

Status

RELATING TO STATE PROCUREMENT REFORM.

Requires procurement officers to document whether to pursue a design professional for damages in the event of construction cost overruns.  Requires the chief procurement officer to compile a public list of construction companies or design professionals that are in noncompliance with the procurement code or owe penalties.  Requires the state procurement office include training on the duty of procurement officers to hold design professionals liable for breaches of professional standards.  Requires the legislative reference bureau to conduct a study on the laws and regulations relating to construction management policies and procedures applicable to the procurement code.

HB 1385

Status

RELATING TO PROCUREMENT.

Implements certain recommendations of the procurement policy review conducted pursuant to House Resolution No. 142, Regular Session of 2016.  Requires the state procurement office to submit a report to the legislature regarding its progress in implementing the procurement policy review recommendations.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be able to testify.  However, all written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

The House will not be responsible for bad connections on the testifier's end.
